Fair Use Policy for Groundsure.io and/or Groundsure Insights Platform.

1. About this policy

Together with the Groundsure Terms and Conditions, this Groundsure.io Fair Use Policy (“Fair Use Policy”) governs how you may access and use the Groundsure Insights Platform, which is provided by us free of charge.

You should read this Fair Use Policy carefully before using the Groundsure Insights Platform.

By using the Groundsure Insights Platform or otherwise indicating your consent, you agree to comply with this Fair Use Policy. If you do not agree with or accept any part of this Fair Use Policy, you should stop using the Groundsure Insights Platform immediately.

Defined terms which are not explicitly set out within this Fair Use Policy shall adopt the meaning given to them in accordance with the Groundsure Terms and Conditions.

2. Acceptable Use

The Groundsure Insights Platform grants you viewing access to mapping and Groundsure Data provided by Groundsure and other Third Party Providers for the sole purpose of identifying your Site, the reasonable viewing of data relating to that Site, conducting Site surveys and ordering/viewing Groundsure Products.

Most Groundsure Data is provided under Open Government Licence (OGL) restrictions but some Groundsure Data does have licensing constraints. Licensing information is provided against each dataset and can be viewed on the “more information section” found within the Groundsure Insights Platform.

3. Unacceptable Use

The backdrop mapping that is provided by Ordnance Survey is protected by Crown Copyright. You are not permitted to copy, sub-license, distribute, sell or otherwise make available this data to anyone other than the Customer or End User, in any circumstances For the avoidance of doubt, this includes taking screenshots of the mapping.

Where necessary, we are willing to absorb costs on behalf of the Customer viewing reasonable amounts of mapping and data. Where Groundsure considers viewing to be unreasonable, Groundsure shall not be obliged to absorb any costs on behalf of the Customer and this shall be notified to the Customer in writing, along with the reason for deeming the viewing as unreasonable.

If it is deemed that you are using the Groundsure Insights Platform outside of the parameters set by this Fair Use Policy, we may remove your access rights to the Groundsure Insights Platform.

 By using the Groundsure Insights Platform, you agree not to:

  • Use the Groundsure Insights Platform for any purpose that is unlawful under any applicable law or prohibited by this Fair Use Policy or the Groundsure Terms and Conditions;
  • To commit any act of fraud;
  • To distribute viruses or malware or other similar harmful software code;
  • In any manner that disrupts the operation of our Site, the Groundsure Insights Platform, business operations or business of any other entity;
  • To promote any unlawful activity;
  • To gain unauthorised access to or use Groundsure Data; or
  • To attempt to circumvent password or user authentication methods.

4. Amendments

Groundsure may amend this Fair Use Policy at any time without prior notice. It is your responsibility to review this Fair Use Policy periodically to ensure ongoing compliance.

Groundsure Explorer Acceptable Use Policy - Upload of User-Created Content to Website and Explorer Platform

1. Purpose

This Groundsure Explorer Acceptable Use Policy (“Acceptable Use Policy”) governs how Customers use Groundsure Explorer and how Customers create, upload or share material on the Groundsure Insights Platform and/or Groundsure Explorer.

By accessing or using Groundsure Explorer and/or Groundsure Insights Platform, you agree to fully comply with this Acceptable Use Policy.

Defined terms which are not set out explicitly within this Acceptable Use Policy shall adopt the meaning given to them in accordance with the Groundsure Terms and Conditions.

2. Permitted Use

Whenever you make use of a feature that allows you to create content directly on the Groundsure Insights Platform and Groundsure Explorer or upload or share content to the Groundsure Insights Platform and/or Groundsure Explorer. (together, “User Content”), you must comply with the standards set out in this Acceptable Use Policy. 

You may use the Groundsure Insights Platform and/or Groundsure Explorer for lawful purposes only. You acknowledge that the User Content uploaded to the Groundsure Insights Platform and/or Groundsure Explorer must:

  • Comply with the law applicable in England and Wales and in any country from which it is posted (“Applicable Laws”);
  • Be related directly to Products;
  • Be limited to your internal business use only and not for commercial resale;
  • Respect all intellectual property rights in accordance with section 4 below; and
  • Adheres to good industry security standards and best practices.

Examples of permitted User Content include (but is not limited to):

  • Project notes and annotations;
  • Site walkover photographs; and
  • Borehole logs and related technical documentation.

3. Intellectual Property

You shall retain ownership of your User Content. By uploading User Content, you grant Groundsure a non-exclusive, royalty-free licence to store, process, and display such content solely for the purpose of providing the services.

You warrant that you have all necessary rights and permissions in the User Content before uploading it to the Groundsure Insights Platform and/or Groundsure Explorer.

4. Data Protection and Confidentiality

You must only upload personal data to the Groundsure Insights Platform and/or Groundsure Explorer which is strictly necessary and compliant under the Applicable Laws, including the Data Protection Act 2018 and UK General Data Protection Regulation (“Data Protection Legislation”). Groundsure shall not be responsible for any personal data you have uploaded to the Groundsure Insights Platform and/or Groundsure Explorer without holding the necessary rights and consents.

You must ensure that confidential information is only uploaded where authorised and appropriate safeguards are in place.

5. Prohibited Use

The following activities are expressly prohibited under this Policy:

  • Attempting unauthorised access to, interfering with or circumventing any security measures on the Groundsure Insights Platform and/or Groundsure Explorer;
  • Uploading or transmitting User Content that:
    • Is unlawful, fraudulent, or otherwise in breach of Applicable Laws;
    • Infringes or misappropriates any third-party intellectual property rights;
    • Contains defamatory, offensive, obscene, abusive, harassing or threatening material;
    • Contains malware, viruses or any other harmful code; or
    • Misuses confidential or personal data, including data protected under applicable data protection legislation.
  • Engage in any activity that may damage, disrupt, or impair the functionality or integrity of the Groundsure Insights Platform, Groundsure Explorer and/or associated systems.

6. Monitoring and Enforcement

Groundsure reserves the right, at its sole discretion, to:

  • Monitor the usage of the Groundsure Insights Platform and/or Groundsure Explorer for the purpose of ensuring your compliance with this Acceptable Use Policy;
  • Remove or disable access to any Customer and/or End-User that breaches this Acceptable Use Policy; or
  • Determine whether any conduct or User Content violates Acceptable Use Policy.

In the event of any breach of this Acceptable Use Policy, Groundsure may:

  • Immediately remove the offending User Content; or
  • Suspend or permanently revoke your access to the Groundsure Insights Platform and/or Groundsure Explorer.

Repeated breaches may result in termination of the services provided by Groundsure to you, in accordance with the Groundsure Terms and Conditions.

7. Amendments

Groundsure may amend this Acceptable Use Policy at any time without prior notice. It is your responsibility to review this Policy periodically to ensure ongoing compliance.
