Under the terms of the Environmental Protection Act (Part IIA) the 'polluter pays' to clean up sites that are deemed by a Local Authority to be contaminated and require remediation. Where the polluter cannot pay or cannot be found, the liability for cleaning up a site may rest with the present owner or occupier of the land. Consequently, those involved in commercial property transactions may wish to consider off-setting any risk through insurance.
